The matter came up before the Supreme Court after private schools challenged a Delhi government notification issued in December, which proposed the formation of fee-determination committees in private schools. The court initially expressed concern over the speed with which the notification was framed and sought to be implemented.

During the hearing, Additional Solicitor General S.V. Raju, appearing for the Delhi government, informed the court that the notification was intended only to initiate the process of forming committees and would not be applied this academic year. Recording this assurance, the Supreme Court stated that there was no urgency requiring its interference at this stage.

While granting interim relief, the Supreme Court made it clear that it has not examined the legality or validity of the notification.
