State's Role in Regulating Madrasa Education Affirmed Up to 'Alim' Level

New Delhi,: In a significant ruling, the Supreme Court of India has upheld most provisions of the Uttar Pradesh Madarsa Education Act, reversing a prior High Court decision. The Court confirmed that the state has the authority to regulate madrasa education up to the 'Alim' level, ensuring standards and oversight for this intermediate religious education.

However, the Court declared certain provisions concerning the 'Fazil' and 'Kamil' degrees unconstitutional, stating that they encroach upon the University Grants Commission's (UGC) jurisdiction over higher education. This judgment underscores the need for a balance between state regulation and educational autonomy, particularly for religious institutions in the state.
