Petition challenging leasing of BU land dismissed

Bengaluru: The petition of challenging leasing a land at Pantharapalya village on Bangalore University (BU) to two institutions was dismissed by the High Court.

An approval was given by the state government to BU on March 17,2020 to allot 15 acres of land for 30 years to facilitate Inter University Centre for Yogic Sciences, New Delhi, to set up a yoga study centre. Similarly, an order that was dated on August 4, 2020, an approval was passed for leasing 2 acres of land costing 2 lakhs per annum to Council for Architecture, a regulatory body constituted by the central government, for setting up a regional centre for three years.

According to KB Vijay Kumar, an advocate, and a former banker, he finds that the land should be declared as a bio park or deemed forest considering the species surrounding the area and they need to explore other land outside the given boundaries for the allotment to the institutions. Above all these escapades Vijay challenged the orders in his PIL.

A division bench headed by acting Chief Justice Alok Aradhe, after perusing the records, noted that the orders under challenge do not suffer from an infirmity. The bench said that the petitioner has failed to make out a case of either a violation of statutory right or any fundamental right in the pleadings. “Allotment of the land has not been made for any commercial purpose. The permission to lease out the property has been granted to Bangalore University in consonance with the Karnataka Universities Act,” the bench observed.
