Mohammad Ali Jauhar University Faces Demolition of 38 Buildings, Here's Why Authorities Took Action

The Rampur Development Authority has ordered the demolition of 38 buildings of Mohammad Ali Jauhar University of UP for not having approved building plans. Officials also added, Apart from the Medical College building, and one Academic Block, the approvals for the rest of the construction do not exist. The university has also disputed the order and stated that the campus was outside the RDA's jurisdiction during the construction of most of the buildings.

What Caused the Demolition of 38 Buildings at Mohammad Ali Jauhar University?

Recently, the Rampur Development Authority has ordered the demolition of 38 buildings at Mohammad Ali Jauhar University, claiming the buildings lack the necessary building plan approval. This has brought further attention to the university. This order comes after the formal inquiry and hearing of the case, and adds to the existing issues the university, founded by ex-Uttar Pradesh minister and Azam Khan, has been facing. While the demolition is being called a justified enforcement of planning laws, the management of the university has challenged this and is standing by the legality of the construction.

What Justifies the Demolition?

As per the Rampur Development Authority, only two buildings, a medical college and an academic block, have approved building plans. The remaining 38 buildings lack necessary building approvals and are deemed unauthorized, per the Uttar Pradesh Urban Planning and Development Act, 1973.

The authority examined the documents, heard the response from the university, and proceeded to review the submissions made by both parties during the hearing, after which the demolition was sanctioned under Section 27(1) of the mentioned Act.

How did the University Respond?

According to the university's representatives in the hearing, the campus in Singankhera village did not fall under the limits of the Rampur Development Authority. Hence, the RDA's consent was not required as most of the constructions happened prior.

The construction of the buildings happened long ago, according to the university's statement. Therefore, such constructions should not be considered illegal due to the changes in the laws. These were dismissed by RDA. It was commented that regardless of whether the area later came under the authority's jurisdiction, consent from the competent authority had to be sought at the time of construction. It was also noted that there were two buildings for which consent was sought, further implying that the university was aware of the need to obtain consent.

What happens next?

It is believed that the university has been ordered to remove unauthorized constructions within the given time frame. If not, legal action will be taken to remove those constructions. At the same time, the district administration has instructed education officials to ensure that any enforcement action does not adversely affect the academic interests of students studying on the campus. If more actions have to be taken, it was reported that counseling and aid measures have been planned to help reduce the impact.

A University at the Centre of Legal Scrutiny

Mohammad Ali Jauhar University, established in 2006 and awarded university status in 2012, has faced frequent media focus due to concerns around land and regulatory issues. Recently, the university has come under extended administrative focus due to the litigation of land leases, planning permissions, and encroachments. The recent demolition order addresses the university’s planning law and infrastructure issues and adds to the regulatory focus on the same concern.

What Does This Mean for Students?

For the current students, the main focus is whether university services will continue to operate. Currently, there is no official information regarding the suspension of classes and/or the academic programs. The authorities have stated that the students’ interests concerning education will be prioritized during the ongoing regulatory and legal proceedings. It is suggested that students should rely on official announcements from the university and/or the respective governmental authorities, as there is a lot of unauthorized information being posted on social media.

Why This Development Matters

This case exemplifies the issues of regulatory compliance in higher education and the building of educational infrastructure. All higher educational institutions should comply with the various regulations concerning planning, construction, and use of land. The concerns arising from this will impact the compliance of higher educational institutions, affect the planning approval processes, and regulate the governance of institutions and infrastructure of the State.

Final Thoughts

The demolition order of 38 building cases at Mohammad Ali Jauhar University leads to many consequences in the cases. The Rampur Development Authority has insisted that the campus buildings violate some of the planning rules. On the contrary, the University has refuted this and defended its stance. Since most of the cases are still under legal and administrative scrutiny, students and interested parties should pay attention to the official communication of the University for the updates concerning the case.
