New Delhi, 23rd December 2024 : The Ministry of Education has taken a significant step towards realizing the vision of the National Education Policy (NEP) 2020 by amending the “No Detention Policy” under the Right of Children to Free and Compulsory Education (RTE) Act, 2009. The amended rules, titled the Right of Children to Free and Compulsory Education (Amendment) Rules, 2024, were notified via Gazette notification (G.S.R. 777(E)) on 21st December 2024.
Key Changes in the Detention Policy
Under the revised policy, applicable to students in Grades 5 and 8 in schools established, owned, or controlled by the Central Government or Union Territories without legislatures:
- Students failing to meet promotion criteria after annual examinations will receive additional instruction and the opportunity for a re-examination within two months.
- If the student fails the re-examination, they will remain in the same grade.
- Teachers will engage closely with students and parents, providing targeted interventions to address learning gaps.
This amendment ensures that no child is expelled from school before completing elementary education, reinforcing the child’s right to education.
Alignment with NEP 2020 and NCFSE
The amendment follows the finalization of the National Education Policy (NEP) 2020 and the National Curriculum Framework for School Education (NCFSE), which was published on 23rd August 2023. The changes were made after extensive consultations with stakeholders.
Implementation Across States and UTs
Eighteen States and Union Territories, including Assam, Gujarat, Himachal Pradesh, Punjab, Tamil Nadu, and Delhi, have already notified the implementation of the RTE (Amendment) Act, 2019. Haryana and Puducherry are yet to decide on the matter.
Meanwhile, other States and UTs, such as Andhra Pradesh, Karnataka, Maharashtra, and Uttar Pradesh, continue to follow the no-detention policy for Classes I to VIII.
Ensuring Equity and Inclusion
The amendment aims to balance the need for academic rigor with equity and inclusion. By offering remedial support and multiple opportunities to succeed, the policy ensures that students achieve essential learning outcomes without compromising their right to education.
This move underscores the Ministry’s commitment to revamping the education system in line with NEP 2020, fostering an inclusive and effective framework for student learning.
