Gandhinagar: The Gujarat Assembly has passed the Gujarat Secondary and Higher Secondary Education (Amendment) Bill, 2026, introducing tighter regulations for secondary and higher secondary schools, including new rules for staff recruitment, special educators, school registration and penalties for violations. The Bill was passed during the ongoing monsoon session of the Gujarat Assembly and amends provisions of the Gujarat Secondary and Higher Secondary Education Act, 1972. The changes are expected to bring greater regulatory oversight over government-aided and private schools in the state.

New Rules for School Staff Recruitment

One of the key changes concerns the appointment of principals, teachers, special educators and non-teaching staff. For government-aided secondary and higher secondary schools, the state government will prescribe qualifications, service conditions and selection procedures for different categories of staff. The amended provisions also require the state's existing reservation policy to be followed in staff recruitment at aided schools. For private, non-grant schools, the government will prescribe minimum qualification requirements for school staff. This puts recruitment in aided schools under a more clearly defined regulatory framework and is expected to reduce differences in the way staff appointments are handled across institutions.

Special Educators to Get a Legal Framework

The amendment also introduces provisions for the appointment of special educators in schools. The provision is aimed at supporting students with disabilities and children with special educational needs. The government has said that the move will strengthen the framework for inclusive education in secondary and higher secondary schools. The amended law provides for prescribed qualifications for special educators, with the relevant training requirements linked to recognised standards.

Penalties for Violations Increased

The Bill also significantly increases penalties for several violations by school managements. For example, an aided school making an illegal appointment of a principal or teacher could face a penalty of up to ₹10 lakh, compared with the earlier ₹1,000 fine mentioned under the previous provision. The amendments also introduce strict penalties for schools operating without the required registration. Running an unregistered secondary or higher secondary school can attract imprisonment of one to two years, a fine between ₹10 lakh and ₹15 lakh, or both. School managements could also face a ₹20 lakh penalty for shutting down a registered school during the academic year without following the prescribed procedure and notice requirements.

Changes in Education Board Representation

The amendment also changes provisions relating to elected representation on the Gujarat Secondary and Higher Secondary Education Board. The revised provisions cover representation from teachers, non-teaching staff and parent associations across different categories of registered schools. The changes are intended to provide representation to a wider set of stakeholders involved in secondary and higher secondary education.

The amendment brings several areas of school administration under a more detailed regulatory framework.
